Just Some thoughts . . .
NPR: “The latest executive order, issued March 31, calls for the Department of Homeland Security to work with the Social Security Administration to create lists of adult U.S. citizens in each state, and to send those lists to state election officials. It also calls for the U.S. Postal Service — a federal agency that is independent of a president’s administration — to come up with lists of eligible voters and to only deliver mail-in ballots to people on those lists.”
Article I of the Constitution grants state legislatures and Congress (not the president) the power to set rules for federal elections. Their lawsuits also contend that Trump’s order directs USPS to make rules about election mail that would overstep the mailing agency’s authority.
Trump just usurped Article 1 and the court is assisting him.
Carl John Nichols (district court judge for the District of Columbia) has basically taken away from state legislatures and local governments to certify that voters are legitimate residents of a precinct, township, county, and state. To which the constitution grants this authority. Furthermore, the USPS answers to Congress and not the President.
Does the judge understand the implications of what he has done. He probably does and if the courts drag this out over time, the nation may be faced with a delay in voting. Five months to voting and Trump has put in place a road block which more likely than not will be overturned. The question is, how soon, and when will the appeals start and how long will they take
The other issue is, the court (Nichols) already knows this.
Side note: I am thinking back to the last election when ~3 million people did not vote when compared to the prior election (2020). Another 3 million chose to vote for others including Kennedy. What did both get for us? You are witnessing it now. A president who intends to do whatever he can to stay in power.
The judge knows he will more likely than not be overturned. Then will Trump appeal? How long will that take. And then off to SCOTUS where Roberts smiles upon Trump’s actions with his and other supporting justice actions. At some point Trump may not care what the courts decide.
Just playing out the scenario of what I am seeing. It may be different.
