I think a Smith report will be public, but possibly just leaked. It is not a public report under law, but a confidential one for the AG. Garland probably will release it, but there is a chance he won’t because another DOJ norm has been not to release derogatory information about uncharged parties. With these dismissals, Trump fits that criterion. In a weird way, it’s possible that not seeking a dismissal “with prejudice” could be an obstacle. As long as the DOJ is leaving open reviving these charges, it may be that going beyond court filings isn’t a good idea. If I had to bet, I’d guess there will be some kind of report.
