A comment I left over at Economist’s View. I am giving it all I’ve got now to clearly define union busting as racketeering that can be prosecuted under RICO. I don’t see any other way in the world to break the Republican-Gordian knot.

Not a word about unions. I checked with “find.” We are not going to accomplish anything else until America restores labor unions. Biggest roadblock: Republicans wont let any national re-unionizing legislation happen — so what to do.
My first thought is some progressives, somewhere have to invoke RICO against union-busting. An employer can fire you for having a grease spot on you tie — and can hire replacement workers (fire you) if you go on strike (my possibly incomplete understanding) — but it is definitely illegal to fire you for organizing a union. Systematically (illegally) firing employees to keep them from carrying out a federally prescribed process of establishing a collective bargaining agent (to deprive them of compensation they might have won in a truly free market) sounds like the definition of racketeering to me. An on going enterprise it surely is.
Somebody has to try. Can outflank the Republicans in one move.
Alternately, in states where it is still possible to pass progressive legislation (WA, OR, CA, NV?), a movement to criminalize union-busting has to get going. Blocking collective bargaining blocks political as well as economic equality and should be punished as a felony. This is the alpha and the omega of everything we have to do. State prohibition automatically sets up RICO prosecution too.
